Loss and Financial Suffering of Kerry Craig Walker
As
the Result of False Arrest on September 25, 2001
1)
On September 16, 2001 a group of five people went to do a tandem skydive
to help get over the depression from 9-11. Before I could do my jump I was
dominated, controlled, and assaulted by a very unbalanced woman. I filed a
police report that same day, but it was never investigated and critical
exculpatory information was left out of the police department's version of
my report. The woman who assaulted me
filed a fake crime report four (4) days after the incident saying I attacked
her. A week later I was
arrested for simple assault, simple battery, and obstruction of a 911 call---all
crimes that were committed against me, not her!

Although there is no way to account for all the money that my false
arrest cost me over the course of nine (9) years, it is certainly well into the
tens of thousands of dollars. I have put together a record of earnings before my
false arrest, but this is just a fraction of the money I’ve lost and the
amount would probably well exceed $200,000.00 (two hundred thousand dollars).

After I was falsely arrested I lost my job as General Manager and
Construction Manager for Patriot Builders Services. I have a Bachelor’s Degree
in Architectural Engineering Technology from Southern Tech in Marietta, Georgia
and I graduated number seven in my field. I was also licensed under Walker
Builders Services but this business never got off the ground before the above
false arrest occurred, setting an unconstitutional chain of events which should
never happen in America. I was ahead several
thousands of dollars when all this began and was able to make ends meet. Once it
became clear that Detective Preston Peavy, with the help of other officers with
the Cherokee County Sheriff’s Department, were attempting to frame me for
these crimes, I knew I must give all of my time to fighting this case for there
to be any hope of keeping my freedom.

I had just gone through a divorce, and was able to keep my custom home
that I personally designed—did two different designs, drew two different
complete sets of detailed working drawings, and physically built from the ground
up.

In order to keep my home I gave my wife a home we jointly owned in
Florida, a lot that I had developed for building in Cherokee County, Georgia on
which I had already started a beautiful custom home. Both of these lots backed
up to Corps of Engineering Property at the corner of the Etowah River and Lake
Allatoona, which made them highly desirable and increased their value. I also
paid over $12,000.00 in taxes that my wife owed and I agreed to give her an
additional $15,000.00 if I ever sold my home.

Eventually, because of this case, I was forced to sell my custom home for
far below market value. I had about $65,000.00 after the sale. I gave my x-wife
$15,000.00 and had $50,000.00 left after the sale. This was a fraction of what I
would have made if I had sold my home under normal circumstances. When I sold my
home and the land, I leased a small tract of land out of the property that I
sold, and this small track of land had a 16 x 24 foot shed on it with a full
loft. I remodeled the shed into a little cabin and ran power to it and water
(but I never connected the water). I was forced to store my things from my home
in storage buildings and find other places for them. For the most part it was at
this small cabin that I fought my case over the course of five (5) years and
fought constantly and persistently in an all out attempt to win against the
State of Georgia and keep my freedom. I had learned enough about the system and
studied enough cases to know that if I was convicted there would be little or no
hope of getting out.

I paid my first attorney, Jeff Rusbridge, $9,500.00 to represent me. I
asked him to file a Motion for a Speedy Trial but this motion was never filed. I
also had a false Stalking T.P.O. filed against me by this same unbalanced
female, yet I was the one that was being stalked! I paid this attorney more
money to represent me in this case and this false T.P.O. was eventually
DISMISSED by Judge John Sumner. My criminal case went on and on for over a year
and a half before going to my first attempt at trial. My first trial ended with
felony tampering with evidence and it was during this trial that Attorney Jeff
Rusbridge became a witness in my case.

Over the course of time I sold possessions to keep fighting my case and
to pay the bills and in order to survive. Over the course of time I sold the
following for below market value: new
Z71 Pickup Truck with extended cab, Jeep Cherokee,
Chevy S-10 pickup truck, 28 foot Winnebago Motor Home, a very nice
ProCraft fishing boat with a Mercury 150 motor, a beautiful MasterCraft 25
anniversary addition ski boat, a motorcycle, and two Polaris ATV’s. There is a
whole list of other possessions that I had to sell in
order to survive and to continue fighting this very long battle. I basically
slept about 5 hours and then I would get up and start fighting my case. I
studied the legal codes and looked into how to fight my case and studied other
cases, as well as the legal system. I sat through some 90 days of hearings and
trials at the Cherokee County Courthouse to learn more about the system. I also
studied the law and read many books to help me understand the law and the legal
processes.

I then was forced to hire another attorney. I paid out $15,000.00 more to
Attorney George Weaver in Jasper, Georgia. This attorney did nothing for me. In
fact, he would not return some 9 phone calls over the course of three months. I
finally went directly to his office and confronted him and demanded my money
back. He refused at first, but I stood my ground and he finally agreed to give
me back half of my money.

I then was forced to hire yet another attorney. This time I hired Jimmy
Berry out of Marietta, Georgia. I paid him $10,000.00 and borrowed $2,000.00
from my very ill mother in order to pay him. I thought this was a good and
powerful attorney, but this attorney had one foot in bed with the State and he
intentionally allowed my case to drag on and on until finally, with my
persistence and my own battle, I got the State to give up on their deceptive
tactics and all of my charges were finally DISMISSED.

I then filled a $20,000,000.00 (20 million dollar) lawsuit in Cherokee
County against Cherokee County, Cherokee County Sheriff’s Department, Sheriff
Roger Garrison, Preston Peavy, et al, and a $1,500,000.00 (1.5 million dollar)
lawsuit in Cobb County against the unbalanced woman that started this nightmare
by filing a fake crime report against me. I have represented myself in these
lawsuits because I have no money left to pay an attorney and I can’t find an
attorney that is willing to fight this difficult battle pro bono.

I was forced out of my cabin by the marshal’s office (because I had no
water) and I moved to Tennessee and lived in a tent for about 7 months. I then
moved into a sailboat (that my younger brother bought) on Watts Bar Lake in
Spring City, Tennessee and stayed there for four months. I worked on this old
sailboat and fixed it up to be a very nice boat. I still had my cabin at this
time and I would go visit this beautiful area when I got the chance and had the
money to get there. Another thing that made all this more difficult was finding
a place to keep my animals. In the beginning of this ordeal I had two great cats
and two fantastic dogs. I had to give up my cats to my x-wife and I had to find
a place to keep my dogs. I took my dogs up to my brother’s place and he takes
care of them most of the time. Beary stays at my brother’s place and Spikey is
actually kept on a friend’s property just up the road from my brother’s
cabin. We have had to get dog houses, 5-gallon feeders, kennels, and build
shelters to cover the food so it doesn’t get wet when it rains.

On June 3, 2009 my girlfriend and I drove down to my cabin and we were
shocked and broken hearted to find it had been trashed out by the Cherokee
County Sheriff’s Department in spite of the fact that the land was in “Legal
Dispute” and we had signs clearly posted. These signs said “THIS LAND IS IN
LEGAL DISPUTE, DO NOT DISTURB OR TRASH OUT.” The land that my property was cut
out of had been foreclosed on and the note had been bought by Wells Fargo Bank.
Attorney Jeff Rusbridge, who is handling this land dispute, had sold me the
signs and instructed how to post them at the property. I also put up a sign with
my name and phone number on it. Instead of doing the right thing and contacting
Attorney Jeff Rusbridge or calling me, the Cherokee County Sheriff’s
Department just cut the locks and had a crew of Hispanics toss out all of
my personally belongings since my childhood
into the rain like a giant pile of garbage. I also had a 12 x 16 foot
shed broke into and over $12,000.00 worth of tools stolen from it. I was forced
to rent and truck and to rent storage buildings in order to put of my personal
belongings, much of which was now damaged by being thrown out or ruined by the
rain. There is now a lawsuit pending in an attempt to get my land and cabin back
and Attorney Jeff Rusbridge is handling this case even though I don’t have the
money to pay him.

After all the judges in Cherokee County recused themselves for conflict
of interest, my case in Cherokee County went to Senior Judge Foster III and it
was in his hands for nearly a year. After this judge was pulled from the case by
the actions of Governor Sonny Perdue (who had covered up for the corrupt actions
of Detective Peavy and other officers of the State), it went to Judge Oliver
Harris Doss, Jr. It was in his hands for about eight or nine months and then my
case was again transferred, this time to Judge Murphy C. Miller. It has been in
Judge Miller’s hands for over a year and I have never had one hearing to
present my witnesses and my side of the story. Judge Miller fraudulently
dismissed my lawsuit, except my expungement claim, and in his pleadings he had
all the facts and even the dates he cited were wrong. Now I am attempting to get
my case to the appellate court. I had a Pauper’s Affidavit approved by Judge
Miller, but now this ORDER has been
unlawfully suspended and a Hearing has been scheduled for Dec. 10, 2010 to
consider the merits of my affidavit (there was a Hearing set for Nov. 8, 2010
but I developed shingles due to a compromised immune system from the stress and
duress of this case and asked for a continuance).

I had filed a Motion to seek Expungement and I went to a hearing on
August 20, 2010 to consider the merits of my motion. I emerged victorious in
that hearing and an ORDER (that was
actually prepared by the counsel for the Cherokee County Sheriff’s Department,
Kendrick K. McWilliams) was signed by Judge Murphy C. Miller which GRANTED my expungement claim. Just recently I got the packet from
the Cherokee County Sheriff’s Office containing the signed forms from the
arresting agency and the signature of the Prosecuting Attorney, Garry T. Moss.
Now I must deliver or mail this packet to the Georgia Crime Information Center
to have my records of my false arrest on September 25, 2001purged from the
criminal records.

As I said, there is no way to calculate all the money I have spent over
the past nine (9) years since I have been fighting this case. I’m sure it
would add up to be well over $200,000.00 if you could add it all up. This does
not take into consideration all the money that I lost by selling everything
below market value or the lost income I have not made because of this long
nightmare in Georgia. But this is not some bad dream, this is the reality of our
broken just-us system. I sure could use a little help fighting this case which
clearly shows how unjust, incompetent, and corrupt the legal process is.

The system failed me in the investigative and charging stage, it failed
me during my attempts at trial, it failed me in my attempts to get justice after
my trial ended in felony tampering with evidence, it failed me in due processes
of law by judges not taking care of business of the court, and it failed me
literally in every aspect of the legal process—and it continues to fail.

I had designed (and accomplished what everyone said was impossible)
and I had physically built my custom home from the ground up, which I had
always dreamed of doing, just for it to get stolen from me by the judicial
system that is supposed to be protecting me from this. Then my nice little cabin
and small tract of land was unlawfully and unethically taken from me. I was
assumed guilty from the start and had to set out to prove my innocence and I was
punished along the way. The judicial process is supposed to prevent laws that
punish without trial by suspending civil liberties, and confiscating property
without due process. With your help my case could
have far reaching impact to help free thousands of men and women who are in
prisons but are not guilty of their crimes. Working together we can bring about
a legal system that works and a legal system that is based on truth seeking
processes of law.
